SoundSend Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Christian Michael Tadros, an individual doing business as SoundSend (“SoundSend,” “we,” “us,” or “our”). They govern your access to and use of the SoundSend iPhone application, the SoundSend extension for Apple Messages, SoundSend Player, SoundDiscover, community features, the website at soundsend.app, and related services (collectively, the “Service”).
By downloading, accessing, creating an account for, purchasing through, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The following policies are incorporated into these Terms:
- the Privacy Policy;
- the Community Guidelines;
- the Acceptable Use Policy; and
- the Copyright and User-Upload Policy.
1. Who operates SoundSend
SoundSend is operated by Christian Michael Tadros, an individual doing business as SoundSend, in Broward County, Florida, United States.

2. Eligibility
You must be at least 13 years old to use SoundSend.
If you are at least 13 but have not reached the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms and permits you to use the Service.
You may not use the Service if:
- applicable law prohibits you from doing so;
- you are subject to sanctions or restrictions that prohibit access to the Service;
- SoundSend previously terminated your account for a serious or repeated violation and has not authorized you to return; or
- you cannot truthfully make the promises required by these Terms.
The mobile app is not initially distributed through European Union App Store storefronts. Availability may vary by country or region and may change.
3. The SoundSend Service
SoundSend allows users to perform functions that may include:
- importing and organizing short audio clips;
- creating and managing SoundBoards;
- installing official SoundPacks;
- maintaining a local or cloud-supported SoundLibrary;
- previewing audio;
- sending supported audio through Apple Messages using SoundSend Player or Universal Audio;
- creating public profiles;
- publishing public sounds and public SoundBoards;
- discovering and saving public content;
- blocking creators;
- reporting content and appealing moderation decisions; and
- purchasing SoundSend Pro.
Some features operate locally without an account. Cloud-backed storage, private SoundSend Player delivery, public publishing, saving, blocking, reporting, purchases, and other features may require an account, network access, or compatible Apple services.
SoundDiscover and the public community launch as a public beta. Beta features may contain errors, change substantially, be interrupted, impose additional limits, or be discontinued. Do not use SoundSend as the only copy of important audio or records.
4. Accounts and Sign in with Apple
You may be required to authenticate using Sign in with Apple. You agree to:
- provide accurate information;
- maintain control of the Apple account and device used to access SoundSend;
- protect your device passcode and authentication credentials;
- promptly notify us of suspected unauthorized access; and
- use only accounts you are authorized to use.
You may not sell, rent, lend, transfer, or license your SoundSend account or username. You may not create accounts to evade restrictions, impersonate another person, reserve usernames in bad faith, or manipulate community features.
We may reject, change, reclaim, or remove usernames, profile names, or identifiers that are misleading, infringing, reserved, inactive, abusive, or necessary for service administration.
You are responsible for activity conducted through your account unless it results from SoundSend’s breach of an applicable legal duty.
5. License to use the app and Service
Subject to these Terms, SoundSend grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for lawful personal purposes through supported SoundSend and Apple features.
The app is licensed, not sold. If you obtain the app through Apple’s App Store, Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”) applies to the licensed application unless a custom EULA is expressly provided through the App Store. These Terms separately govern SoundSend accounts, cloud services, community features, user content, purchases, and conduct.
You may not, except where applicable law expressly permits:
- copy, sell, rent, lease, sublicense, distribute, or commercially exploit the app or Service;
- reverse engineer, decompile, disassemble, or attempt to derive source code;
- bypass authentication, security, moderation, purchase, storage, duration, rate, or access controls;
- use the Service to create or supply a competing audio library, scraping service, dataset, or content-distribution product;
- remove legal, copyright, trademark, or proprietary notices;
- access the Service through unauthorized automated means; or
- use SoundSend intellectual property except as expressly allowed.
Open-source software included in SoundSend is governed by its applicable open-source licenses.
6. SoundSend Pro and Apple in-app purchases
SoundSend Pro is offered as a one-time, non-consumable in-app purchase. The current U.S. price is US$2.99, although the price shown by Apple may vary by storefront, currency, tax, or later pricing decision.
SoundSend Pro expands the account’s limit to up to 50 personal uploaded sounds. Duration, format, file-size, security, moderation, and reasonable abuse-prevention limits still apply.
Unless the Apple purchase sheet expressly states otherwise:
- SoundSend Pro is not an automatically renewing subscription;
- payment is charged by Apple to the Apple account used for the purchase;
- Apple handles billing information, taxes, payment processing, and applicable refunds;
- eligible purchases may be restored using Apple’s restore-purchase mechanisms and the Apple account associated with the purchase; and
- deleting your SoundSend account or app does not automatically cancel, reverse, or refund an Apple transaction.
A “one-time purchase” means there is no recurring charge for that product. It does not guarantee that every feature, cloud service, operating system, device, or third-party dependency will remain available forever. SoundSend may modify the Service, but will not knowingly convert an existing one-time SoundSend Pro purchase into a recurring subscription without a new, clear purchase decision by the user.
If an entitlement is refunded, revoked, charged back, obtained fraudulently, or otherwise invalidated by Apple, SoundSend may remove the corresponding Pro access.
7. Your content
“Your Content” means audio, sounds, recordings, music, speech, profile information, usernames, biographies, artwork, images, icons, titles, descriptions, SoundBoards, reports, feedback, and other material that you import, upload, submit, send, or publish through the Service.
As between you and SoundSend, you retain ownership of Your Content. SoundSend does not acquire ownership merely because you use the Service.
You are solely responsible for Your Content and for deciding whether it should remain private, be sent to a recipient, or be published to the community.
7.1 Rights you must have
You represent and warrant that, for each item of Your Content, you have all rights, licenses, permissions, consents, and releases needed to:
- possess and upload it;
- store and transcode it;
- send it to the recipients you choose;
- publish it to SoundDiscover if you choose to publish;
- authorize SoundSend to operate the Service as described in these Terms; and
- authorize other users to use public content through the SoundSend features you enable.
Depending on the content, this may require rights in:
- the sound recording;
- the underlying music, composition, lyrics, or script;
- performances;
- voices, names, images, and likenesses;
- artwork and photographs;
- trademarks, logos, or brands;
- confidential information; and
- privacy, publicity, and recording consent.
A clip’s short duration, humorous purpose, attribution, noncommercial use, private-library status, or availability elsewhere does not by itself establish that the use is authorized or legally protected.
You may not upload, send, or publish content that violates law, another person’s rights, these Terms, the Acceptable Use Policy, or the Community Guidelines.
7.2 Private content license
When you keep content private, you grant SoundSend a worldwide, non-exclusive, royalty-free license to host, store, copy, validate, transcode, technically modify, hash, cache, synchronize, secure, and deliver that content only as reasonably necessary to:
- maintain your private library;
- provide playback and synchronization;
- complete user-directed SoundSend Player delivery;
- prevent duplicate or corrupted uploads;
- provide support and security;
- comply with law; and
- enforce these Terms.
This private-content license is limited to operating the features you request. It generally ends when the content and associated backups are deleted, except for copies already delivered to recipients and records SoundSend is permitted or required to retain.
7.3 Public content license to SoundSend
When you deliberately publish content to the SoundSend community, you grant SoundSend a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to:
- host, store, reproduce, transcode, cache, transmit, distribute, make available, publicly display, and publicly perform the content;
- create technical adaptations needed for compatible playback, artwork sizing, accessibility, security, moderation, or delivery;
- display your public username, display name, avatar, biography, attribution, and related public engagement information with the content;
- review, moderate, label, restrict, feature, organize, recommend, and include the content in search, discovery, trending, or editorial surfaces within SoundSend;
- allow service providers to process the content as needed to operate SoundSend; and
- allow other users to use the content through the limited in-Service license described below.
This license exists only to operate, secure, moderate, and present SoundSend and its supported features. SoundSend will not use Your Content in external paid advertising or unrelated promotional campaigns without separate permission.
7.4 Limited license to other users
When you publish content, you grant other SoundSend users a limited, worldwide, non-exclusive, royalty-free, revocable license to play, save, organize, and send that content only through supported SoundSend features and only for personal, noncommercial use.
This license does not permit another user to:
- extract or download content except through an expressly supported feature;
- re-upload it as their own;
- sell, sublicense, license, or commercially distribute it;
- use it to build a separate sound library, dataset, application, or service;
- remove attribution or rights information;
- use a creator’s name, likeness, trademark, or brand except as displayed by SoundSend; or
- use it outside the scope of the rights you actually possess.
Other users do not acquire ownership of public content by saving it, adding it to a SoundBoard, or sending it through SoundSend.
7.5 Unpublishing, deletion, and existing copies
The public-content licenses granted to SoundSend and other users generally end prospectively when you unpublish or delete the content, subject to reasonable processing time. The following may remain:
- copies already sent through Apple Messages or another supported delivery feature;
- copies cached, recorded, or downloaded on another user’s device;
- temporary backup copies pending ordinary deletion;
- records required for copyright, moderation, safety, fraud prevention, audits, or legal claims; and
- technical copies needed to finish a delivery or action initiated before removal.
SoundSend is not required to retrieve content from recipients or third-party systems it does not control.
7.6 Generative artificial intelligence
SoundSend will not use user audio, voices, music, artwork, or likenesses to train generative artificial-intelligence models without a separate, affirmative opt-in from the applicable user and any other required rights holder.
This restriction does not prohibit non-generative technical processing reasonably needed for functions such as file conversion, duplicate detection, search, security, spam prevention, moderation, rights management, or service reliability.
7.7 Feedback
If you voluntarily send ideas, suggestions, or feedback about SoundSend, you grant SoundSend a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use and incorporate that feedback without restriction or compensation. This does not transfer ownership of unrelated content included in a support request.
8. Official SoundSend content and SoundPacks
SoundSend and its licensors own or control the app, branding, visual design, software, official SoundPacks, official audio, artwork, and other SoundSend-provided content (“Official Content”).
Subject to these Terms, SoundSend grants you a limited, personal, non-exclusive, non-transferable, revocable license to install, play, organize, and send Official Content through supported SoundSend and Apple Messages features.
You may not:
- extract Official Content from SoundSend for separate use;
- re-upload it as user-created or community content;
- resell, sublicense, redistribute, or commercially exploit it;
- use it to create a competing sound library or service;
- remove attribution or proprietary notices; or
- imply that SoundSend sponsors, endorses, or is affiliated with you.
Installing a SoundPack or sending an official sound does not transfer ownership.
9. Public community and other users’ content
SoundSend hosts public content at the direction of users. Other users’ content belongs to them or their licensors and may be inaccurate, offensive, infringing, unavailable, or unsuitable for you.
SoundSend does not endorse user content merely because it is published, featured, popular, saved, or available in a public beta. You use and rely on user content at your own risk.
You may report content and block creators using the released app. Saving a community sound or SoundBoard creates access or organization relationships; it does not transfer ownership. If the original content is removed, fresh playback or download may stop even if a local cached copy remains temporarily available.
10. Apple Messages, recipients, and delivery
SoundSend may provide:
- SoundSend Player, which can use a SoundSend-controlled share capability and hosted audio for compatible recipients; and
- Universal Audio, which inserts a standard audio attachment into Apple Messages.
You choose the sound, delivery method, conversation, and whether to use Apple’s send control. You are responsible for:
- having permission to send the content;
- selecting the intended recipient;
- avoiding spam, harassment, unwanted repeated audio, and deceptive messages; and
- understanding that recipients can keep or redistribute what they receive.
A private SoundSend Player capability may remain available until the sender deletes the source sound or account, revokes the share, or SoundSend disables it. Short-lived playback links may be generated each time a valid capability is resolved. SoundSend cannot guarantee recall or deletion from a recipient’s Messages history, device, backup, recording, or other storage.
Delivery depends on Apple, network access, compatible software, account state, hosted-content availability, and recipient settings. SoundSend does not guarantee that a message will arrive, remain playable, appear in a particular format, or be treated as private by the recipient.
11. Acceptable use and Community Guidelines
You must comply with the Acceptable Use Policy whenever you use SoundSend. Public profiles, public content, and community behavior must also comply with the Community Guidelines.
Among other things, you may not use SoundSend for infringement, nonconsensual recordings, threats, targeted harassment, hateful conduct, sexual exploitation, child abuse material, fraud, impersonation, malware, spam, service disruption, security bypass, or unlawful activity.
SoundSend may impose reasonable duration, file, storage, publication, request, playback, and rate limits. You may not evade those limits through multiple accounts, modified software, automation, false information, or other circumvention.
12. Reports, moderation, and appeals
SoundSend may use user reports, human review, technical signals, content metadata, and other reasonably available information to review content or conduct.
SoundSend may, with or without prior notice where permitted by law:
- reject or delay publication;
- label content;
- reduce or remove discovery eligibility;
- hide, remove, or disable content;
- revoke a private share;
- limit uploads, saves, or publishing;
- change or reclaim profile information;
- suspend or disable a public profile;
- suspend or terminate an account;
- preserve relevant evidence; or
- refer matters to service providers, rights holders, or authorities.
Decisions may consider context, severity, intent, repetition, risk of harm, prior violations, reliability of reports, legal requirements, and the limitations of a public beta.
Where practical or legally required, SoundSend will provide notice and a reason for an enforcement action. You may appeal through an available in-app appeal option or by emailing [email protected]. An appeal does not guarantee restoration, and SoundSend does not promise a fixed response time unless required by law.
SoundSend may take immediate action without advance notice in urgent safety, security, fraud, child-safety, legal, or severe-abuse matters.
13. Copyright and other rights complaints
SoundSend respects intellectual-property rights and maintains a policy for responding to notices of claimed infringement. Copyright notices and counter-notices must follow the Copyright and User-Upload Policy.
SoundSend may remove or disable content upon receiving a compliant notice, notify the uploader, process a compliant counter-notice, and restore content after the statutory waiting period if appropriate.
SoundSend may suspend or terminate users determined to be repeat infringers in appropriate circumstances.
Reports involving privacy, impersonation, publicity rights, harassment, or other non-copyright issues should use in-app reporting or [email protected].
14. Privacy
The Privacy Policy explains how SoundSend handles information. By using the Service, you acknowledge that SoundSend may process information as described there.
Do not use SoundSend to collect, expose, or distribute another person’s private or sensitive information without authorization.
15. Third-party services and Apple
SoundSend depends on third-party services that may include Apple, Supabase, Cloudflare, Google, and network or infrastructure providers. Their services are governed by their own terms, and their availability is outside SoundSend’s complete control.
For an app obtained through Apple’s App Store:
- these Terms are between you and SoundSend, not Apple;
- SoundSend, not Apple, is responsible for the SoundSend service and user content handled by SoundSend;
- Apple has no obligation to provide maintenance or support for SoundSend;
- Apple handles App Store payment processing and may handle refunds under Apple’s rules;
- you must comply with applicable Apple Media Services terms and usage rules; and
- Apple and its subsidiaries are intended third-party beneficiaries of the provisions concerning the Apple-distributed app and may enforce those provisions.
To the extent permitted by law, SoundSend is not responsible for third-party outages, policies, content, payment decisions, account restrictions, or actions.
16. Service changes
SoundSend may add, change, limit, suspend, or discontinue features to improve the Service, address legal or security risks, respond to provider changes, manage costs, enforce policies, or operate the public beta.
We will provide notice of a material change when reasonably practicable or legally required. Some changes may be required immediately for security, legal, safety, or technical reasons.
You are responsible for maintaining your own lawful backup of important source audio. SoundSend is not an archival storage service.
17. Changes to these Terms
We may update these Terms. The updated version will identify its effective date. If a change materially affects existing users, we will provide additional notice through the app, website, email, or another reasonable method when required.
Your continued use after updated Terms become effective constitutes acceptance to the extent permitted by law. If you do not agree to an update, you must stop using the Service and may delete your account.
Changes do not retroactively alter rights that cannot lawfully be changed without your consent.
18. Suspension, termination, and account deletion
You may stop using SoundSend at any time. In the released app, you may initiate permanent account deletion through:
Profile → Settings → Account → Delete Account
Reauthentication or reconfirmation is required.
Account deletion is intended to delete private cloud uploads and the authentication account, revoke private shares, remove public content, remove account relationships, and anonymize the public profile, subject to the retention and third-party-copy limits described in the Privacy Policy.
Deleting an account:
- does not retrieve messages or audio already delivered to another person;
- does not erase copies stored outside SoundSend;
- does not automatically refund an Apple purchase;
- may make cloud-backed sounds and public content permanently unavailable; and
- may leave nonpublic moderation, copyright, security, transaction, or legal records where retention is permitted or required.
SoundSend may suspend or terminate access when reasonably necessary for a violation, risk, legal obligation, provider requirement, nonpayment or entitlement revocation, security incident, or discontinuation of the Service.
Upon termination, your license to use SoundSend ends. Provisions concerning ownership, licenses for existing delivered copies, feedback, disclaimers, liability, indemnity, disputes, and other provisions that by their nature should survive will continue.
19. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
SOUNDSEND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
SOUNDSEND DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT A PARTICULAR TIME;
- CONTENT WILL BE PRESERVED, DELIVERED, PLAYABLE, ACCURATE, LAWFUL, OR SUITABLE;
- MODERATION WILL IDENTIFY EVERY VIOLATION;
- PUBLIC-BETA FEATURES WILL CONTINUE;
- A PARTICULAR DEVICE, IOS VERSION, APPLE SERVICE, OR THIRD-PARTY SERVICE WILL REMAIN COMPATIBLE; OR
- ANY DEFECT OR DATA LOSS WILL BE CORRECTED.
SOUNDSEND DOES NOT ENDORSE OR ASSUME RESPONSIBILITY FOR USER CONTENT OR FOR WHAT A RECIPIENT DOES WITH CONTENT SENT TO THEM.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, these disclaimers apply only to the maximum extent permitted by law.
20. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOUNDSEND AND ITS OPERATOR, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, CONTENT, GOODWILL, OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, SOUNDSEND’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- US$100; or
- the amount you paid directly for the SoundSend product or feature giving rise to the claim during the 12 months before the event giving rise to liability.
These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence where the law prohibits limitation, or death or personal injury caused by negligence where applicable law does not permit exclusion.
Your local law may provide non-waivable consumer rights or remedies. Nothing in these Terms excludes those rights.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SoundSend, its operator, contractors, and agents from third-party claims, damages, judgments, liabilities, losses, and reasonable legal expenses arising from:
- Your Content;
- your infringement or violation of another person’s rights;
- your material violation of these Terms or incorporated policies;
- your unlawful, fraudulent, or intentionally harmful use of the Service; or
- your misuse of another person’s account or content.
This section does not require you to indemnify SoundSend for SoundSend’s own fraud, willful misconduct, or liability that cannot legally be shifted to you.
SoundSend may control the defense of a covered claim and will reasonably cooperate with you. You may not settle a claim in a way that admits liability for or imposes obligations on SoundSend without written consent.
22. Governing law and disputes
These Terms and disputes between you and SoundSend are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law applies or your local law provides non-waivable protections.
There is no mandatory arbitration requirement in these Terms.
Subject to any non-waivable right to bring a claim elsewhere:
- state-court disputes must be brought in the state courts located in Broward County, Florida; and
- federal-court disputes must be brought in the United States District Court for the Southern District of Florida.
Either party may bring an eligible individual claim in small-claims court.
Before filing a lawsuit, the parties are encouraged, but not required, to attempt in good faith to resolve the dispute by contacting [email protected].
23. Export and sanctions compliance
You may not use, export, or re-export the app or Service except as authorized by United States law and the laws of the jurisdiction where the app was obtained.
You represent that you are not located in a country or region subject to a comprehensive U.S. government embargo and are not listed on a U.S. government prohibited or restricted party list.
You may not use SoundSend for a purpose prohibited by applicable export-control or sanctions laws.
24. Miscellaneous
Entire agreement. These Terms and the incorporated policies form the agreement between you and SoundSend concerning the Service, subject to Apple’s applicable Standard EULA and non-waivable law.
Order of control. If these Terms conflict with an incorporated policy, these Terms control unless the policy expressly states that it controls for its subject matter. The Copyright and User-Upload Policy controls the process for copyright notices and counter-notices.
Severability. If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue.
No waiver. Failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms without SoundSend’s written consent. SoundSend may assign them in connection with a reorganization, financing, sale, transfer of the Service, or by operation of law, subject to applicable law.
No agency. These Terms do not create an employment, partnership, joint venture, fiduciary, franchise, or agency relationship.
Electronic communications. You agree that notices, disclosures, and agreements may be provided electronically through the app, website, or email, subject to applicable law.
Headings. Headings are for convenience and do not limit interpretation.
